The Supreme Court Strikes Down DOMA! How Does This Affect the Same Sex Couple

The best news for same sex couples occurred on June 26, 2013 when the Supreme Court, in an historic ruling, struck down the Defense of Marriage Act.

The Good News:

In the 13 states that recognize same sex marriage, the couple should be able to, among other things: (1) file joint federal income tax returns; (2) receive tax benefits for estate planning purposes; (3) apply for a green card for a spouse.

The Bad News:

In the states that do not recognize same sex marriage, federal benefits are probably not available for same sex couples. So for example, in a state like Illinois that recognizes civil unions but not same sex marriages, you still will not be able to file a joint income tax return.

More Good News:

Look forward to a plethora of lawsuits challenging individual states’ DOMA.
